Strada Construction was contracted to perform sidewalk repair in the Village of Stickney. This repair work included a strip of sidewalk immediately in front of the plaintiff’s home. In the month before Memorial Day of 2010, Strada began excavating the existing sidewalk when work was halted due to tree root impinging on the sidewalk site. The plaintiff was on his way home when he walked across the excavated sidewalk suffering a fall and a back injury. The plaintiff alleged that Strada failed to properly warn pedestrians of the excavated sidewalk.
